1. Agreement Overview
These Terms and Conditions govern the provision of food photography services by Alison McMath Photography (“Photographer”) to the client (“Client”) as outlined in the service agreement or contract. By booking a session, the Client agrees to these Terms and Conditions.
2. Services Provided
- Scope of Work: The Photographer will provide food photography services as detailed at the consultation, including the number of hours of shooting, edited images, and any additional services as agreed upon.
- Deliverables: Final deliverables will be provided in digital format as specified in the package.
3. Payment Terms
Fees: The Client agrees to pay the total fee as outlined in the service agreement. Full payment is required when booking.
- Payment Methods: Payment can be made via debit/credit card/bank transfer.
- Late Payments: A late fee of 10% per day will be applied to overdue invoices.
4. Booking and Cancellation
- Booking: The session is confirmed upon receipt of the deposit and signed agreement.
- Cancellation: If the Client cancels the session less than 48 hours before the scheduled date, the deposit is non-refundable. If the Photographer must cancel due to unforeseen circumstances, a full refund or rescheduling option will be provided.
- Rescheduling: Rescheduling requests must be made at least 48 hours in advance. The Photographer will make reasonable efforts to accommodate the new date, subject to availability.
5. Revisions and Adjustments
- Included Revisions: The number of revisions included is as specified in the selected package. Additional revisions beyond what is included will incur a charge of £10 per revision.
- Client Feedback: The Client is responsible for providing feedback and direction during the revision process. The Photographer will not be liable for delays caused by the Client’s feedback.
6. Image Usage and Rights
- License: The Photographer grants the Client a non-exclusive, royalty-free license to use the images for the purposes outlined in the service agreement. Any additional use beyond the agreed scope requires further negotiation and licensing.
- Ownership: Copyright of all images remains with the Photographer. The Client may not resell or license images to third parties without permission.
7. Client Responsibilities
- Preparation: The Client is responsible for preparing the food or products and ensuring they are ready for the photoshoot. Any special dietary or preparation instructions should be communicated in advance.
- Props and Styling: The Client is responsible for providing any specific props or styling elements unless otherwise agreed upon in the service agreement.
8. Travel and Additional Costs
On-Location Shoots: For shoots further than 10 miles from PR7 1XE, travel expenses will apply. Expenses will be calculated at 45p per mile.
- Additional Costs: Any additional costs or services not included in the selected package will be discussed and agreed upon prior to the photoshoot.
9. Confidentiality
The Photographer agrees to maintain confidentiality regarding any sensitive or proprietary information shared by the Client during the course of the project.
10. Limitation of Liability
The Photographer’s liability for any claim arising out of this Agreement is limited to the total amount paid by the Client for the services. The Photographer is not liable for any indirect, incidental, or consequential damages.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England, UK. Any disputes arising from this Agreement shall be resolved in the courts of Lancashire, England, UK.
12. Amendments
These Terms and Conditions may be amended or updated from time to time. The Client will be notified of any significant changes.
13. Acceptance
By booking a session, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
